PAIA Manual

What this is: South African law gives any person the right to request access to records held by a private company, where that record is needed to exercise or protect a right. This manual explains what records we hold and how to ask for them.
Important: the exemption has lapsed. The limited exemption that once relieved smaller private bodies from compiling a PAIA manual ended on 31 December 2021. Every private body in South Africa, regardless of size or turnover, must now have this manual available, must have a registered Information Officer, and must submit an annual PAIA report (a nil return is still required). See section 9 below.

6. How to request access to a record

  1. Complete Form 2 (Request for Access to Record of Private Body), available from the Regulator's website.
  2. Send the completed form to the Information Officer at the address in section 2.
  3. State clearly:
    • which record you want, in enough detail for us to identify it;
    • the form of access you want (inspection, copy, transcript);
    • your postal or email address, and a contact telephone number;
    • the right you are seeking to exercise or protect, and why the record is required for that purpose. This is a legal requirement for requests to private bodies, and a request that does not explain it will be refused;
    • if you are making the request on behalf of someone else, proof of your authority.
  4. Pay the applicable request fee (section 8).

We will decide on your request within 30 days of receiving it, and will notify you in writing. In limited circumstances this period may be extended by a further 30 days, in which case we will tell you why.

7. Grounds on which access may be refused

Access to a record must or may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA. These include:

Access may nonetheless be granted where disclosure is in the public interest, as contemplated in section 70.

8. Fees

Two kinds of fee may apply, as prescribed by regulation under PAIA:

A requester who seeks access to a record containing their own personal information is not required to pay a request fee.

We apply the fees prescribed in the PAIA Regulations, as amended from time to time. The current prescribed fees are published by the Information Regulator, and we will confirm the amount payable in writing before proceeding.

PAIA manuals must now also describe how the body processes personal information.

A data subject may object to processing, or request correction or deletion of their personal information, using Form 1 or Form 2 prescribed under POPIA, sent to the Information Officer.
